I have gotten some conflicting information. I have heard there needs to be a change of status beforehand. Can someone tell me the form that is needed. THanks

Hi, Before getting married, she actually has the right to work on a K-1 visa. The trick is getting a SSN to give to the employer, so they will relax about hiring her. See Doc Steen's web site for more on this: http://www.mindspring.com/~docsteen/visainfo/visainfo.htm After getting married, you file for the EAD at the same time as AOS, but the time it takes to get it varies from 1 day to almost 3 months, depending on which office you have to file at. Thanks for the help. Would you by any chance know which office in Texas can handle the AOS and EAD? I have a mailing address in Mesquite, but live in Houston and I know they have a big office here. I would like to go in person in Houston if they allow it, but it seems that the information site is not real clear. If you choose to apply for EAD, EAD forms would be a part of your AOS package. The whole reason of giving separate work permit document is that it can be used WHILE the paperwork for Adjustment of Status is processed. You can't file ONLY for EAD. Therefore the necessary steps would be 1) get married, 2) prepare AOS documents and EAD form, 3)File personally or mail AOS and EAD forms + all necessary paperwork to INS. It will depend on your INS office how long it will be before your girl actually receives EAD. Some offices issue it on the same day you file the papers in person, mine (we live in Seattle) took me exactly 30 days (filed in perosn on August 8th, EAD received September 9th).

It was the same day. We turned in all of our paperwork, as we were already married and they scheduled the AOS interview for another day, but fingerprinted and issued the EAD on the spot.
