Has anyone ever used the K1, but not married so the GF returns home and then you marry in her country and apply for the K3? My goal is to get her up here to spend some time here, but we're not ready to marry yet. She is an extreme long shot for a tourist visa, so a K1 looks like the easiest way to get her here for a while.

I will be in Lima with my honey in 56 hours!!!!!

As posted below, the K1 is for 90 days, and it is no big deal if she returns without getting married before the 90 are up, but if she overstays the 90 days, then it’s a big deal and good luck getting any kind of visa after that. As far as filing another k1 after she leaves, it can be a pain in the butt. I did it with my fiancée last year. She was here for three weeks when her mother fell down some stairs at her home and went into the hospital. Since we were not married yet, we decided that she needed to go home and take care of her mother, long story, and this is the short form of it, but we filed again and she was approved for another K1, but they wanted letters notarized stating what happened. If they feel that you used the first K1 visa for a vacation, they will not issue another one and she will be on a list of visa abusers.

Well...with all due respect, technically you are bringing her here on the K1 with the preface of not getting married.  But, if she is going back, I don't see what it would hurt.  

My thoughts... I would hope that our government has some feelings, and understands that love/relationships/marriage don't always follow the book.   I would think that it would not be a problem.  

I think the K1 allowed for a 120 or 150? day time limit at one time.

90 days is the limit on K-1 visas...

I guess that is what I meant...at some time in the past it was for a longer time frame.  Wink
