I was able to talk to an attorney who deals with K-1 exclusively. I asked him a few questions on the delays. This attorney explained that congress has mandated the INS process certain cases first like (illegal aliens amnesty cases, political asylum, etc.) which leaves K-1's in the crapper. This attorney felt that calling a congressmen was fruitless that it was congress causing the problem with their mandates and lack of funding. The attorney explained that from observations the INS adjudicators are hard workers who are overwhelmed. The attorney stated that he informs his clients just to sit it out and wait and also explained that the times on the Notice of approvals 60-90 days mean nothing, that they come from the main INS office and that the local offices are told what to list as projected processing dates without much meaning. My thoughts all hogwash! I do believe that calling your congressman can help. Like any government agency the squeaky wheel gets the grease especially if it's a congressmen. So I don't by that it will do no good. Second any attorney who makes a living filing forms with the INS surely avoids trying to irritate them. For us it's a one time deal, but for them it could be a nightmare dealing with INS each day with multible cases. Plus it makes no diffrence to him if it takes 10 days or 300 days it's not his life and gets paid no matter what. So once again it's crapola. My impression was that this attorney felt guys like me who complain are a pain in the a@#.
I called my congressman who said he would help and started the process to do just that. Just explain to him that some INS official probably thinks your wasting his time. It's time to upset the apple cart. Tell the INS that no one believes they're overworked and if they don't like the work Mickey "D's" is hiring.
