I have a question for you guys. About filing a I-130 with a kid involved. Now, I know the I-130 spousal visa process, because I did it myself when my wife and I got married. However, my wife's sister is getting married and she has a kid about 5 years old. Do you fill out two I-130's or one. I have read when you file an I-129 you can do that petition with the child listed. I would assume you can too with a I-130, because those forms are so similar. Yet, Ive also read it can be better if you fill out a seprate I-130 for the kid. Which leads me to another question, I would assume you fill out a G-325A bio form on the kid too. It has me little confused. I will probably call the INS to check, but I want to run it by you guys too. Thanks, Golden

I would check with the embassy in Bogota if thats where you are filing,they have a web site.I believe we did only one I-130 putting my wife and step son on it,but I know for sure they want 2 affidavid of support forms,I forget the number.I got sent home from Bogota to get second affidavid of support form,notarized in the US,with original W-2's and 1099's.Now maybe the official was a little overzealous or maybe it could have been done differently.I have heard you can get forms notarized at the Embassy and why do they need 2 sets of original W-2's and 1099's? I wasn't at that interview,I was waiting at the hotel.After being in Colombia over 3 weeks already I just came home and sent my wife what they asked for.
Kids complicate things alot.Be sure you have a recent consent letter from the childs father(if the father is shown on the birth certificate)for the child to leave the country.You need it at the Embassy and at the airport when you leave with the kid.And you need a new one every time the kid leaves the country in the future,as in returning to The US from vacation.It must be less than 60 days old.

Pete, I just went through the process and the embassyin Bogota wants an I130 for each person you are petioning for.  So in this case, it would be two I130s.  The fee is $130 for each.
