Author Topic: A Final Visa Question?  (Read 6160 times)

I recently got married with my wife entering on a K-1.  I'm now filling out the adjustment of status form (I-485) and the affidavit of support. The advance parole will be filed after I get the filing receipt for the first two documents.  Am I overlooking anything else for right now?

I did not have to wait for the receipt for the I-485 to file for the advanced parole.  You can file for the advanced parole at the same time that you file for the I-485.  You also may want to consider filing for the EAD or enployment auth. document at the same time.  I do not know if she has an SS# yet but she can easily get one with the EAD.  In fact, I believe the SS offices require it now, but I could be wrong.  They take her picture for it and she receives a laminated card with her foto on it for the EAD.  For the advanced parole you need to furnish (2) INS fotos.
You can accomplish all of this with one trip to the INS.

We filed last Feb. and my wife had her interview last Thursday.  She was approved for her conditional residency or green card.  It is always an experience at the INS office.  Saw one other guy there with a latina wife and it looked like their cute little daughter.  She was from Mexico and was quite striking.  I saw some guys (mainly arabs) getting detained because now they are having to register.  Their wifes were not too happy.

The interview went fine with the officer going over some of the questions on the I-485.  Asking my wife where we live, has she ever received publish assistance, does she have any children.  It is good that her level of speaking and understanding english is good now.  I was proud of her.  He asked me how we met.
I had to have supporting documentation of a shared household.  Tax returns jointly filed.  Insurance documents showing her also.  I do not have a joint bank account with her, but that is good evidence.  I had plenty of evidence with many fotos and he was satisfied we are legitimate.

Thank you very much for your response.  I'll pick up the EAD tomorrow.  Is it necessary to specify a specific reason (e.g., expertise in a specialized field) when requesting permission to work?  The mirrors are down but I'm not the one who did it, LOL.  In fact, the whole house is looking quite a bit different and yes, probably better.

When you get the application, you will see that you do not need to specify a specific reason but you do need to specify a specific category under the different eligibity categories.

por ejemplo.

K-1 Nonimmigrant Fiance(e) of US Citizen or K-2 Dependent is category (a)(6).  You use this category if you are filing within 90 days from the date of entry.  This EAD cannot be renewed.

The one you are interested in is:

Adjustment Applicant -- (c)(9).  File your EAD application with a copy of the receipt notice or other evidence that your form I-485, Application for Permanent Residence, is pending.  You may file Form I-765 (EAD) together with your Form I-485.

My house also looks quite a bit better and my wife and I have the same taste in furnishings.
