Hi I am just back from vacation with my fiance in Portugal. I
know I asked some questions in the spring but we postponed
our paperwork until now. My fiance wants to go to Brasil to see
her mother this winter so we waited to start the documents.

I have one question about paperwork. Do I need to have a letter
stating from each of us that we were never married in the
packet? I have this question because I called the INS and they
said no but sometimes they seem to not even knowwhat is
needed. Thanks in advance.

Here is what I will have for my packet for fiance visa

1 I-129 fiance form
2 325 biographic info for each of us
3 a letter from each of us intending to marry
4 pictures of us together
5 letters from each other or emails.
6 passport photo from each of us for documents
7 ticket stubs for flights to see her.
8 $165 for processing.
9>copy of birth certicate from myself
10> copy of her birth certificate in Portuguese and also translation to English notorized.

No, you don’t need a letter stating that you were never married. The embassy where you process the visa application may or may not require her to submit further documentation showing that she was never married. They also may ask her to provide further evidence of a valid relationship, proof of meeting, or originals for any document copies submitted with your petition.

On the Forms G-325A, make sure that you enter “NONE” where it asks for “Husband or Wife” and also enter “NONE” where it asks for “Former Husbands or Wives”.

On the Form I-129F, check the box for “Single” in parts A.6. & B.6.  In parts A.10. & B.10., enter “NONE” for names of prior husband/wives.

Your document list looks O.K. You do not have to submit her birth certificate, but it wouldn’t hurt to include a photocopy. She will probably be asked for a certified original of her birth cert when she goes in for an interview. Also, you can include a signed statement attesting to the fact that document copies submitted are exact photocopies of unaltered originals.

For your birth cert, make sure it’s a photocopy of a certified copy from an official government agency, not the original from the hospital.

Will you process the visa in Portugal?

Thanks a lot Ray for the info I was going to leave the married questions
blank on the 325. Yes she has been working in Portugal for three years
now and it is the best way to go for both of us. This is why we will
process the visa thru Portugal which is no problem she had contact with
the local US consulate but they will not give out any info until I do the
documents from here.

Ray I do not need her birth certificate for the intitial paperwork? I guess
they will ask her after the papers are sent to the Lisbon US consulate.

I have to look at my birth cert again but it has a stamped seal so it
should be the original State of NY cert. I used this when I got my US
passport. Thanks again I know the info on visas is in the archives but this
is good for new comers to get updates to the process.
