I have a question about the K1 and if anybody here has done this. My fiancee is in Portugal but she is a Brazilian national. Does she have to stay in Brazil to do the paperwork or can we file the K1 while she continues to work in Lisbon. I looked at some of the visa processes and it sounds like she would have to go back to Brazil while we do the paperwork? She is close to both the US and Brazilian consulates in Portugal so I don't see why we couldn't file without her being in her home country? Any answers are appreciated thank you.

You can file the petition here no matter where she is. Does she intend to stay in Portugal and process her K-1 visa there? Lots of people have K-1 visas processed in the country of residence. There is no requirement to apply for a fiancée visa in your country of citizenship.

You or she needs to contact the nearest U.S. Consulate in Portugal and confirm that they can process her K-1 visa application there and get all the details on their local procedures. She may need to get some legal documents or police clearances from Brazil, but I don’t see any reason why she would have to travel back home for that.

What ever happened to your plan to get married in Portugal?

Hi Ray thanks for the message. We both decided not to marry in Portugal because she did not want to do it there. Now it looks like we will go for the K1 and then later we can have a nice ceremony in Brazil for her family. I was the one that offered to her, to marry in Portugal but she was not as interested. I would not mind getting married in Brazil but I don't think she wants to wait for the paperwork to process without a job. She has a decent job in Lisbon so this is probably the best way, we file the papers while she stays working.

After I get get her status adjustment and she could go to Brazil to see her mother for a couple of months. She wants to go spend time with her after our marriage and I don't have a problem with it, and maybe she could set up a ceremony for us her, mother is pretty religious and knows some priests so we could always get married a second time but we wouldn't have to file paperwork for legality purposes. I know it sounds confusing but we all have this in some sort of way when you marry a foreigner.
