Mental degenerates? Let's be fair now.

That is a touching story but those INS people have to follow the law and I don’t believe that the INS has the authority to make exceptions to the law. My understanding is that this kind of thing happens frequently and the standard procedure is for the local congressional representative to submit a bill in congress on the individual’s behalf making an exception to the immigration laws in their case. I'm sure the congressman would love the publicity in an election year if he pushed a bill through.

Also, there seems to be something missing in the story. If, as she said, "this is our home", why have they apparently been here for 10 years on a work visa? There was no real explanation why they haven’t gotten permanent residence or citizenship in that time other than the fact that he changed jobs once (?).

Please don't take this response as an endorsement of the fine people working at the INS :-)

 So far as I know there a quite a few ways the the INS can create eceptions to the law and in fact enforce the law quite at their own whim. I could give them a call tonight and inform them about the exact location of 200 100% illegal aliens and and whether or not they take any action is quite up to them...most likely, they will take no action. There are tens of thousands of people here on expired student visas for which the INS is taking no action. So careful enforcement of the law is what the INS does NOT do.
In fact they issued student visas for several of the 9/11 hijackers some months after the event. I believe that they can grant visas on humanitarian grounds at the administrative level within the INS. Congress gets into the act when they refuse to act in glaring obvious cases like this. After all, the INS can't be bothered with little cases like this woman as they are busy getting visas ready for the next batch of terrorists.

  I posted this link as merely a somewhat typical case of how the INS is screwed up in their priorities.

I agree with most of your points regarding the INS Nathan.

But I don't understand what this woman is crying about now. Apparently this case has already gained worldwide attention a long time ago. Also, there is already a bill in congress to grant her permanent residence status. I don't know what the status is now, but she hasn't been deported has she?

Notwithstanding title III of the Immigration and Nationality Act (8 U.S.C. 1101 et seq.), Deena Gilbey shall be entitled to naturalization as a citizen of the United States upon being administered the oath of renunciation and allegiance in an appropriate ceremony pursuant to section 337 of the Immigration and Nationality Act. Upon naturalization of Deena Gilbey under this Act, the Attorney General shall record the date of naturalization of Deena Gilbey as being September 10, 2001.
