The affidavit of support can be withdrawn...go figure.

In your situation Travis, I would say that the marriage should have been annulled (IMO).
How else then, can the affidavit be rescended?

I couldn't get an annulment because of state law...if there was fraud involved in the marriage, annulment is permissable but if you cohabitate after learning of the fraud, then an annulment is not allowed. The catch is, you cannot remove the spouse from your home without a court order, therefore your forced by law to cohabitate...catch 22 sorta thingy.

I went to her adjustment of status interview and they said their going to remove my affidavit of support. It wasn't what I expected as I didn't think it was a doable thing. Needless to say I was surprised and very pleased with the outcome of the interview!!!
