K3 AOS AND 1-130???

hello pepz!

i have a question for those who have a K3 visa. i was told by the Immigration person (800-375-5283) that my wife does not need to file for her AOS until the I-130 petition is approved. Now is this true? I know I spoke to the immigration, but sometmes they could be inaccurate.

some people told me that my wife should file AOS asap.

Her K-3 visa should be good for 2 years and is also good for work authorization and multiple entries, so there may be no need to file anything ASAP. I would make sure that the INS service center is aware of the K-3 visa, so they can process the I-130 accordingly.

I'll let some of our K-3 people comment on their experience.
