HELLO EVERYONE.

my wife is waiting for her K3 instructions to arrive from the US embassy in Manila. I want to know what Form do i need to submit: I-134 or I-864??? also, what is the next step after getting the K3 instructions.

PLEASE ADVISE.....SALAMAT!!!!

There is no requirement for an affidavit of support with the K-3. She will need to submit Evidence of Support documentation including your most recent federal income tax return, and Form W-2 with employer letter and recent pay stub if you are currently employed.

The embassy will send your wife a letter advising her where to pay the application fee ($45?). They should tell her to submit her passport, 2 completed copies of the DS-156, her birth certificate from NSO Manila, marriage contract from NSO Manila, NBI police clearance, Evidence of Support docs, evidence of a genuine marriage (letters, photos, etc.), 2 color visa photos, and foreign police clearance from any country outside the Philippines where she lived for over 1 year.

She will be advised to go to St. Luke’s clinic for her medical with all her documentation and the fee for the medical exam ($85?). After she completes the medical, they will take all her paperwork and submit it to the embassy. Then she waits for the visa to be delivered to her by courier. Normally there is no interview.

Just to be safe, she should also have certified copies of any photocopied documents you submitted with your application, ESPECIALLY including the COMPLETE divorce decree if applicable. They may or may not ask for these.

is there other forms other the form DS-156 that my wife will recieve in her Instructions?
could you please tell me so i can download some forms and fill it, in that way it will be easier for my wife to fill them out.

The DS-156 is the only form that I know of that she will receive from the embassy to be completed. Maybe some of the guys that have recently completed the K-3 process can add more info...

since when is the form I-134 not required? isn't it the evidence of support same as the affidavit of support?
how about the I-864? what's the difference?

Get a copy and prepare the form.  Also download the DS-156 and send your wife a copy with most of the answers filled in.  She can use it to complete her copy that she'll receive from the embassy.

thank you guys for all your responses....when was this I-134 scrapped if it really have been scrapped?....for those of you who have gone thru all the K3 processes, how complicated is the filling up of the K3 Instructions?

Hey Jeff,

When did they start requiring the I-134 for K-3? As of last month it was Not required according to the information I have.

Did anyone have the embassy specifically ask for it? Dingo? Bear? Chris?

I-134 is no longer asked for at St Lukes! At least that's what the new k-1 packet says. They only want your last year's tax return, w-2 copies, and employer letter.

The change is probably due to the fact that the I-134 doesn't require the tax return unless you are self-employed.  Must be they really want to see it so they are scrapping the I-134.

Jeff,

I think the I-134 went out sometime last year. My understanding is that it wasn’t legally enforceable anyway, so they pretty much dropped it. The I-864 is the enforceable affidavit that is filed before they will grant permanent resident status. What the embassy is really looking for is evidence that you will be able to support her so the government won’t have to. So, they look at the supporting docs that were required with the old I-134 but don’t make you sign your life away.

Note: Just for info, don’t believe everything that that you hear over there at Mag-Anak. I swear some of those guys are paranoid about his paperwork drill. They will tell you to submit everything including the kitchen sink. In all my dealings with the government, I just give them what they ask for, no more and no less, and everything goes smoothly most of the time. If you give them stuff they don’t want or don’t need, you just confuse them and waste everyone’s time.

There are some members at Mag-Anak (whom I won’t name here) that are trying to be helpful but don’t know their arse from a hole in the ground. If they don’t know what they are talking about, I wish they would just be quiet. I don’t understand why they feel the need to answer every darned question, whether they know the answer or not. Oh well….

Sounds about right to me.  Now that I think about it, my wife's K3 package might have mentioned "Evidence of support," rather than "Affidavit of Support."  I never looked at it but that's what I think I remember my wife saying.  Then it listed what to bring in that regard.

Thanks for the encouragement on our K3.  Hopefully it will be resolved soon.

What about the I-134 Affadavit of support for the Fiance Visa? do we have any current info on that?
If its still needed?
My timeline is just starting folks... :-)

Sent in I-129F  on Feb 7.
Received at NSC Feb. 8.

Mog,

The I-134 is NOT required for the K-1 or the K-3, unless the petitioner’s income is not sufficient to meet the U.S. Federal Poverty Guidelines, in which case you will need a co-sponsor to file an I-134 affidavit of support.

Ours is K3 Petition and here's our Timeline so far:

- sent I-129F December 18, 2001
- received at NSC December 21, 2001
- First NOA January 9, 2002 :Petition Approved
- Letter from the NVC recieved January 18, 2002: Approved case emailed to the US Embassy in Manila
-  Wife currently waiting for the K3 Instructions packet - wife called and was asked for her passport number before they could send her the packet....could have gotten already if Passport was ready....

..that's it so far
