What about Tneals' suggestion of an annulment?
From what I remember, I think you have the grounds for an annulment.

Don,

That's what I was thinking, but isn't an annulment a Catholic thing?  We were married Lutheran and neither is Catholic.

Howard,
 My aunt had an annulment and she isn't Catholic, Methodist or even Communist.  Smiley  They did it on the   basis of the marriage never being consumated.   To my understanding an annulment is a legal action not connected to any church.

It is also a legal thing.  I think you qualify for several

You're right, you don't need an annulment since the wedding didn't take place in the Catholic Church. It also occurred in the US. The Philippine government would recognize a US divorce. They had no issues with my divorce in my Catholic first marriage. My divorce and The Catholic Church...that is another matter...nothing a few Hail Marys and money couldn't fix. ;o))

Dave,

The Philippines MAY recognize a U.S. divorce, depending on the circumstances. This is my understanding of Philippine law:

A divorce between two Philippine citizens, no matter where the divorce is granted, is not recognized under Philippine law.

A citizen of the Philippines who is married to a foreign national can legally divorce overseas IF the foreign spouse files for divorce. If the Philippine citizen files for the divorce, it is not recognized in the Philippines, and under Philippine law, the Philippine citizen cannot remarry.

Once a Filipino is granted citizenship in another country, Philippine marriage laws no longer apply to them.

A judicial annulment...That would be awesome! Declaring the marriage invalid due to fraud.

Stephen, our resident lawyer, goes into the legalities of annulment - at least the California version. It's something you should find out about in your state.
