What do you need from the fiance to apply for the K1?
« on: April 28, 2016, 06:16:11 PM »
Lets say you meet a woman outside of the USA.

At some point you decide to apply for her K1.

What is needed FROM HER (the fiance)?

From what I understand the applicant needs the birth certificate, local ID and passport of the fiance all translated into english by a professional translation service.

Is there anything else?

Documents needed from fiancée for submission of I-129F K-1 petition:

1. Original Form G-325A (Biographic Information) for your fiancée
2. One recent color passport photo of your fiancée
3. Copy of documents showing legal termination of any previous marriages
4. Signed original statement of her intent to marry within 90 days of arrival
5. Legal documents to support any name changes shown in submitted documents.
6. Copy of fiancée’s birth certificate (not required but recommended)
7. Copy of fiancée’s passport ID page (not required but recommended)

Translations:  Any foreign language document must be accompanied by a full English translation that the translator has certified as complete and correct, and by the translator's certification that he or she is competent to translate the foreign language into English.

Note: There will be further documents she will need later for the interview.

There is no need for me to start my own website...this one works just fine thank you.   :P

It's easy to just tell someone to go dig up the info he needs at Visa Journey. I think it's much more helpful to just tell him what he wants to know if you have been through the process yourself and know the answer. You could just as well have told him to go google it.

Visa Journey is a good website with tons of valuable information that could be very helpful during the actual process of petitioning your foreign spouse/fiancée. However, the specific info he is asking about can be found right here in the Planet-Love community. This topic has actually been discussed here many times.

But the best place to find the answer to his question is on the USCIS Forms Page...  https://www.uscis.gov/forms

That's where you'll find the current fiancée visa forms (I-129F) and accompanying instructions. The required K-1 submission documents listed on Visa Journey were copied from the official USCIS instructions anyway.

I added the last two optional items because those were previously discussed here on this forum by William III (God rest his soul), one of our contributing immigration attorneys. He recommended those two items be included with the petition because, from his extensive experience, he said those could often prevent possible delays and RFI's in some cases. He felt it was well worth the cost of a couple of photocopies.

Can you find that additional info on Visa Journey? Maybe, but you probably have to dig through thousands of pages of discussions trying to find it. like a needle in a haystack.

Passport photo, as in any 2in x 2in color photo with a white background?

What are the other documents for the interview? And you do mean the interview by the US embassy in her country, right?

Yes on the photo. Specific requirements are listed in the I-129F instructions.

https://www.uscis.gov/sites/default/files/files/form/i-129finstr.pdf

Yes, interview at US consulate in the country where she will apply for the visa. Check website of individual consulate and/or National Visa Center (NVC) for documents required for visa application and interview.

Does this statement need to be in english? Written? Typed? Doesnt matter?

If in a foreign language does it need to be professionally translated?

In other words, should the letter of intent be in her native language or english? Or does it not matter?

If her IMBRA is in her native language, does it need to be translated into english?

Yes, the letter of intent and ALL submitted documents must be either in English or include an English translation. Hand written in Spanish is OK if legible and translated to English.

A paid professional translator is not required.

Not sure what you mean by "her IMBRA"?
