IMBRA and what it means to me?

I've been reading about IMBRA and I think I'm more confused now than I was before I started. I'm using a pay site where the vast majority of the women are foreign national citizens and there is absolutely no IMBRA related disclosure of information relating to my marital status, criminal history, or anything else for that matter. What am I facing when I do meet the one? From what I've read, it seems to me that as long as she is fully aware that I have been married and am now divorced, that I have grown children, and that I have no criminal history we will be ok because it will all come out at a K1 interview?.?.? Is this correct or do I need to start gathering documentation together to present to anyone that I wish to talk to before I even say "Hi, My name is Bill"???

What you need to know is that if you are using an international dating website or agency where you pay for services and the girls sign up for free... then it falls under IMBRA.

Technically regardless of if it is LatinAmericanCupid.com or Latin-Wife.com (or any other agency) it falls under the IMBRA law.

Now if you meet a girl on Facebook or Myspace... you are in the clear.

You pay to meet women in person or online intros/swapping contact info... it falls under IMBRA.

What all gets enforced is up for debate however. That's the only confusing part. But the law isn't that hard to understand really. It is kinda like speeding... you might go 75 in a 55 and get away with. But still it is clearly against the law.

Sometimes you might have an agency owner say well its not enforced... or since they operate in Colombia (or whatever country) they aren't breaking any laws... but remember you are the one asking the US government to let in your fiance. The risk is all on your shoulders.

My understanding is agencies are illegal in the phils. But a site like Cebuanas legally falls under IMBRA. I doubt they or many businesses comply.

It sounds like you are using an IMB company that is clearly not complying with IMBRA requirements before facilitating you’re contacting their women members.

Probably the worst that could happen to you if you should file a K-1 or K-3 petition for a woman that you met on that site is denial of her visa application because of the company’s non-compliance with IMBRA.

The fact that you made your own full disclosure to the lady on your own might help your case at her interview or it might not. I have no idea how many visa denials have happened because of non-compliance with IMBRA, but the possibility of that happening is there.

If you marry her overseas and file a CR-1 spouse petition, then IMBRA is irrelevant under the law and it doesn’t matter if the company you used for contacting your wife is complying or not.

I'll let William correct me if I am wrong on that...

The site I'm using is InternationalCupid, it's a sister site to FilipinaHeart, just not as specifically Philippine. The fact is that they do not gather nor do they distribute any data the women. After reading IMBRA I became a bit concerned.

Does the fact that there is no requirement to pay make a difference? I pay so that I can use the extended search features and it allows those that I contact to reply free of charge, but there is no requirement for anyone to pay. Now if someone doesn't pay there can't be any real communicaton, so knowing this, is this a loop hole? Does the fact that there is no reqiuirement for anyone to pay side step the IMBRA issues?

This is really just a rhetorical question because I see the answer to my concern already posted above; CR1.

I don't think so, but I will leave this legal opinion to the attorneys...
