IV ENTRANTS USUALLY RECEIVE THEIR RESIDENT CARD WITHIN WEEKS OF THEIR ENTRY. RESIDENT ALIENS CAN TRAVEL FREELY HOME AS THEY WISH- REMEMBER THAT THERE ARE RESTRICTIONS ON THEIR STAYS ABROAD CONCERNING TIMES FOR US CITIZENSHIP ACCRUAL AND POTENTIAL ABANDONMENT OF RESIDENCY.
THE K ENTRANT MUST MARRY WITHIN 90 DAYS AND HAVE FILED HER AOS. ASSUMING THAT THE AOS IS TIMELY FILED WITH THE SERVICE AND THERE IS A REQUEST FOR ADVANCE PAROLE INCLUDED (no extra charge), THE FIANCEE/WIFE WILL HAVE PROBABLY SPENT SIX MONTHS OR MORE IN THE UNITED STATES BEFORE SHE WILL BE ALLOWED TO TRAVEL HOME TO VISIT.
Are there any kind of advantages to either visa (k-1 or k-3) when it comes to children?
NOT REALLY-THE CHILDREN ARE DERIVATIVES TO MOM'S K VISA. HOWEVER, OLDER "CHILDREN" CAN QUALIFY TO ENTER AS A K2 AND ESTABLISH A STATUS THAT THEY CAN'T QUALIFY FOR AS AN IMMEDIATE RELATIVE. IV LIMIT IS MARRIAGE BEFORE 18 FOR THE STEP RELATIONSHIP AND FIANCEE STILL ALLOWS ENTRY UP TO AGE 21.
I also understand that with each child you have to file either a k-2 or k-4 for each, depending on whether you have filed a k-1 or k-3.
NO- WHILE THERE WILL BE ADDITIONAL FILINGS FOR THESE CHILDREN AFTER THEIR ARRIVAL, THE SPECIFIC K2/K4 ARE DERIVATIVES AND REQUIRE NO SPECIFIC INDEPENDENT FILINGS ON BEHALF OF THE CHILDREN
Also, I am going to have a bit of a fight in bringing the children here, so how tough a fight is that?
DEPENDS ON WHO YOU ARE FIGHTING WITH. FIGHTS WITH THE OTHER PARENT ARE SELDOM WON IF YOU END UP WITH HIM ASSERTING HIS RIGHTS IN HIS HOME COURT. BETTER METHOD IS TO PAY FOR HIS SIGNATURES ON RELEASES AND GET THE KIDS UP HERE.
If I work in Colombia what kind of visa do I need, or if I obtain a cedula do I need a visa? Or if I marry there will that eliminate the need for any kind of work visa?
