pregnancy and the k- 1 visa

  Me and my girl were both curious about something.  If i got her pregnant while visiting her would that affect her coming here, or would that effect the visa process negatively in anyway. I told her from my research that it would not but she is the kind of person that likes solid proof so any thoughts and advice on this from the vets would be appreciated thanks.

It could affect her visa approval if she were pregnant for her medical exam, but only if there was any question that you weren’t aware of it.

If you were to send her a notarized, signed statement to the effect that you are aware of the pregnancy, so she could submit that along with her documents at her visa interview, there should be no problem at all.

Now if she were to deliver before she arrived here, there may be another delay because you would need to have the birth registered overseas at the embassy along with the required proof to establish the child’s US citizenship. The child would then be traveling with her on his/her own US passport with no visa required for the child.

Also, depending on how far along she was when it came time to fly, she ‘may’ have some problem with the airlines allowing her aboard(?)

little effect if any on the process.  Generally, it might be construed as a positive factor unless your passport stamps show that you were probably not there for the impregnation. They could request DNA if they doubted the parentage.

It could also affect her ability to use the visa due to her condition at time of visa issuance or complications that medically prevent her from travel.

I checked on Reports of Birth Abroad with the US Cosulate in Cebu. It accepts
Consular Reports of Birth Abroad (CRBA) applications, which are then sent to the American Embassy in Manila for adjudication. Interviews are conducted at the US Embassy in Manila. Oh well, I tried to avoid going to Manila. Maybe I should wear my purple thong for the Gabriela crowd to ehhhhh show my support... Gabriela whose motto is "Guilty"   even when proven INNOCENT! Yeah! That's the ticket!

Hey Heruamen,

I would do whatever it takes to avoid getting her pregnant before marriage! It might not effect the visa process negatively, but why risk damaging her reputation with her family, coworkers, and friends? Once you are married, the Philippine attitude is "the sooner she is pregnant, the better!"

once your fiance gets her visa are you allowed to marry her anywhere, or does she have to wait to be here?  Like for example once she gets her visa could you just marry her in her country before she comes here to the U.S.?

HOWEVER, if she married over there before she left, the visa would be no good and you would have to start all over again with a spousal visa petition.

She must be unmarried when she enters the US on a K-1 visa! If they even suspect that she is married, she could possibly be turned away at her POE.

That doesn't really help you at all, unless you happen to be going to the Cebu consulate for something else anyway.

The application and supporting documents are accepted at the embassy in Manila by mail or courier service. Since you have to submit your passport and other important documents, I would definitely use the courier service. You call the courier and they will pick up your paperwork at your home and deliver it to the the embassy. Then, after the interview in Manila, the courier service will deliver the certificate/passport to your door, so it looks like you can probably do everything in one trip to Manila.

No, not at all! But it sure would have been nice! It would be OK for guys living in Cebu who wanted to have their documents proof read...that's about it.  ;D

We have the NSO birth certificate.

Not sure when we will go, but will let you know how it works out. Such a pain in the azz to leave paradise and go to Manila!!!

basically this is a civil ceremony with out all of the legal documentation.
As far as all of her friends & family are concerned she is married to you.
this may be an option that you want to look into

If it’s just a pre-marriage or engagement party, and it’s part of the cultural tradition of the country where she lives, then you probably will be OK.

HOWEVER, if it’s called a wedding, and everyone considers you married, then it’s a fake wedding. These are not traditional in the Philippines.

Fake weddings without documentation are dangerous. To repeat what I said, if they even suspect that she is married, she can be denied and even possibly banned for attempted visa fraud. It’s too easy to get tripped up during the face-to-face interview.

Instead of trying to beat the system with a “fake” wedding, be a man and marry her for real with the proper documentation. Then petition her for a spouse visa. You owe your bride a real wedding on her special day.
