  Hi Researcher,

No, I really am not all that concerned about the IMBRA Gestapo kicking my door in. They don't seem too gung-ho about enforcing the rules and I have nothing to hide from my lady anyways. (well, not really) I will show her my criminal record and my record of my first marriage going down in flames and have her sign something saying she's seen whatever past drama I've been through.
  But I think I'm more concerned about will I actually be able to AFFORD to get her back to the states. The mess the U.S. is in right now financially, they might jack up the cost of the marriage visa even more now to bail out some more banks or ? - Yikes!! >:(

                  That's about all you can do.Just thought I would bring that up since I just went through the process myself.They won't kick your door in but they can deny your visa. Things had changed from the time I had met my wife to the interview we had and I am sure they will continue to change.The USCIS does now ask if an IMB was used and they want contact info.(Question # 19 on the I129f).I am sure at one point they will enforce IMBRA. I sure wouldn't want to be the first that got denied because I wasn't aware of what was going on. And if I were still looking I wouldn't use an agency that wasn't IMBRA compliant.

For anyone worried about complying with IMBRA or having their visa application denied because they didn't use an IMBRA compliant agency, you always have the option to marry over there and petition her for a spouse immigrant visa with Form I-130.

In this case, for all practical purposes, IMBRA does not apply.

That's strange. IMBRA only applies to K type non-immigrant visas. Form I-130 is for an immigrant visa.

Which line item on I-130 asked if you had used an IMB? I can't seem to find it(?)

My wife completed the I-130 to petition her mother last year. I can't remember them asking if she met her mother though an IMBRA compliant agency.

At the risk of prolonging the drama just a bit further, some developments to close out this topic.

Over the past few days, sean126 and I have been exchanging emails to determine if there was a path forward. Those communications concluded today at an impasse.

It is my understanding that sean will not return to PL - neither as a moderator or as a regular member.

Without divulging the details of the communications, I will simply state that the exchanges were cordial, professional and I believe, sincere. It is a shame we were unable to reach agreement, but there are situations in life in which reasonable people will disagree on important points - and this is one of them.

The exchanges revolved around a number of issues, and the end result is that PL continues to be committed to the following tenets and principles (among others):

* PL remains committed to providing a service to all its members - Commercial as well as Regular Members. That service is to facilitate the exchange of information in order for people to make informed decisions that, hopefully, increases their chance of success in this endeavor. We seek to harm no-one in this process and do not wish to see this venue become a platform for hate-speak or blacklists or other such non-productive outlets.
* Private information of any sort that would harm someone is NOT to be posted on PL. This extends to a first name if the member is protective of that information. Our default position needs to be that no-one should divulge ANY personal information about another member.
* In the past, and dating to Patrick's founding of this site in the mid-1990's, we have asked that any criticisms or complaints be brought only by those who have direct first-hand experience and can present their complaint based on fact not hearsay. We are now, as always, committed to this foundational principle of fairplay.
* The role of a "Moderator" is a difficult one. To be effective, they must be, and be seen, as impartial and fair. Any action that might be interpreted as favoritism, or the reverse, castigation, of a particular party by a Moderator undermines the PL venue.
* PL has repeatedly demonstrated our long-standing interest in honesty, integrity and equity amongst all parties - men, women, and agencies. We created the Agency Code of Ethics as a written code for agencies to follow, and for men and women to use in evaluating the merits of an agency - any agency. We created a forum here specifically dedicated to following tightened rules of engagement so that anyone with a grievance might be assured of having their grievance heard, and receiving fair and equitable treatment along the way to a result provided by the membership at large.

If anyone has any questions, please feel free to ask - though, for obvious reasons, I will not divulge any private communications I had with sean.

     Sorry guys, let me be a little more clear and simple with this.I don't always have alot of time to post and don't explain things fully.I filed an I130 but at the embassy interview I still had to explain how we met and then provide contact info of the agency that we used.You see, you complete the forms(I130) and then send them in etc, etc...then you have what is called an "interview" at the embassy(in the country of your spouse).That's where you go and they talk to you.Then, they can ask you anything they want and if they don't like your answers, you get denied.There's more to it than that but I didn't want to get too detailed in my explanation. I hope that's enough info for you guys.

OK, thanks for clearing that up.

I wasn’t trying to give you a hard time or anything, but the reason that I was confused by your response about being required to answer the IMB question after filing the I-130 was based partly on your earlier post where you said the USCIS asks the question and you referenced Form I-129F (question #19).

Did you also file a K-3 petition? That would probably explain why you were questioned about it at the interview. Which visa was she being interviewed for? K-3 or CR-1?

You are correct that the consular officers at the visa interview can ask any questions they wish and yes, they can and do deny visas based on your answers to those questions. HOWEVER, they have no “legal” basis to deny a CR-1 spouse visa solely because you or the agency you used didn't comply with IMBRA, because IMBRA does not apply to immigrant visas.

Also, the interview is for the applicant (your wife) and whether or not you are even allowed to be present at or participate in the interview is at the discretion of the individual consulate. Were you required to attend the interview?

I remember one guy who attended his wife's visa interview in Manila and the interviewing officer asked him when was the last time he had sex with his wife. She almost got denied because he blew his top right there at the interview. I guess sometimes it's better that you don't attend...  :D

  No, I wasn't required to attend but having gone through the process before I felt it was best.I know of a couple that was questioned seperate and the CO asked both if they had sex yet(for a fiancee visa).The man said no because that's what he thought his fiancee would say but she told the truth and said yes.Their visa was denied. Some couples breeze through the process while others have nothing but problems. I have ran across USCIS people that were nice and helpful and some that weren't.IMO, one should always be prepared for the worst.I learned to have more than enough to present to the government but only give them what they ask for.
Too many people dive into this without learning what it takes to get a visa and others decide to just "risk it" unprepared.

Funny story and on topic sort of.

My uncle married a woman from the Seychelles.  At there immigration meeting (she was already in Canada at the time), the interviewer asked them a bunch of questions, but the one that almost cost them their papers, was "how many clocks do you have in your kitchen?"

My uncle forgot about the clock on the stove while she did not.  Because their answers to that 1 question didn't match up they suspended the paperwork to do further investigation.  We laugh about it now, but it scared the heck out of them at the time.

Just a reminder to always be prepared and always tell the truth.  The interviewers are there to judge your relationship, and not you personally.

Everyone has his good parts and their bad.  Jaime no exception.  As you no doubt now know a bad temper.  I would really hate to see you go because you bring a lot of good things to the board.  Your humor being the best thing.  Don't let some guy that everyone praises so much get to you.  He wins if you let it happen.  He is not perfect.  I found that out the second time I went to Barranquilla.  I dated a lovely girl that worked in his office.  She told me that he treated his employees like crap.  He yelled at them all of the time.  So he has a bad temper and to needled you he used your name. and did it knowing you didn't like it.
It’s something how people make judgments so quickly. Without going into all the reasons why, since its understood by Dan I was not trying to expose anyone’s name for spiteful purposes.

As for having a bad temper, yes I will yell at new born babies, but outside of that I have a very calm temper.

Let me ask you some questions:
The only feedback you ever hear from the girls that have worked for me is that they do very good work. Do you think that’s an accident? Or requires some effort on my part to make happen?

Other regions of Colombia make jokes about how lazy the people are on the coast and that they only want to party and not work. Have you ever heard this? Do you think it may be true? If so do you think maybe that this would require a little more intensity than for someone more inclined to work hard?
 
If you want an honest dialogue you would state who the ex-translator is. I believe I  know and that she is now in the U.S. and her first name begins with a V. I also believe you won’t say, because why reveal the source its easier to just to play Joseph McCarthy.

If I really did treat my employee as you say she said, “like crap.” Why would they not go elsewhere? The answer to that is I pay most of them more than anyone else would and they like working here. The reality is most bosses in Colombia truly treat there employee like crap through sexual harassment, excessive work hours and low pay. If such employees complain they know they are easily replaced and that finding a new job without references is difficult. If you ever saw the living conditions of most maids you would know the little value those with authority have over their employees. I have heard dozens of stories to know how employees are treated here and it is paradise working for me in comparison.

Now do I ever raise my voice, you bet I do. I have high expectations for those that work for me and when I come across repeated blunders, senseless errors or critical mistakes my feelings on the matter become known and if someone wants to designate that as yelling so be it. But I wouldn’t call it that, because if I ever got to the stage of yelling I would fire such a person. If I had to yell to make my point or achieve quality work I would not have that person working for me. Do some of my employee not like my requirements? I am sure they don’t, but I am not here to satisfy there expectations, but the expectations of my clients and if someone that works for me has hurt feelings because they felt they were harshly treated then I can only suggest they not repeat the error that brought this up. I have posted on my website the difficulties of doing business in Colombia. My experience was posted on another board and every single person that was running or tried to run a business in Colombia agreed with me. If I really had such a bad work environment and did not know the appropriate way of dealing with my employee then it’s not likely I would still be in business after 6 years.

On this board I live in an open house everyone gets to recollect every second-hand and anonymous accounting of almost every aspect and behavior I take or don’t take. Fortunately I am not here for style points. I’ve also never claimed to be anywhere close to perfect nor did anyone else. I try my best, I need to do better and fortunately our efforts to date have done well for others.

I think Jaime has said more than enough on here so that most folks will be cautious about using his agency now.
I have been hearing this ever since I have been on this board and guess what, I keep growing. What you find as harmful I find helpful for others to see. I will actually point potential clients to the thread you are referring to and there have been many more caustic ones that I have been in the middle of that I have also pointed potential clients to. I want them to see my responses, the ones you think hurt me, because they don’t think the same way, otherwise I would not be growing where other agencies have been falling. I want them to see what the guys who have used our services say good and bad. I wish every single visitor posted his experience with us, unfortunately 99% don’t. So if you think this hurts me go back to archives when sharp objects were allowed and tell me why that didn’t all those threads hurt me?

Well maybe it’s because potential clients are more concerned with the likelihood of what I can do for them and not the opinions of non-clients. Maybe they think I am right and others are wrong. Maybe they think you are right and I am wrong, but the positives out weigh the negative or that my wrongs may be irrelevant to the likelihood of their success. Whatever it is, the reason I am not concerned by what you think is I know my target market. My typical client is a business owner around 40 who is educated, intelligent and knowledgably and can decipher the bull [snip] accusation thrown my way. They see your perceived victory of take caution with Jamie as no more victories than Sudan’s shouts of victory over the United States in the smolders of Baghdad after his invasion of Kuwait.

There is one surefire way to avoid this outcome. Give the relationship enough time to develop as if you would if she were here. Thinking that you have fallen in love with a stranger you can't even talk to (8 times out of 10) no matter how good she looks, has got to be the silliest thing a normally thinking man can conceive of...

I can understand somewhat if you aren't used to beautiful women, having the shock of a lifetime setting foot in Colombia, but don't automatically assume that you have struck gold without full verification. More than likely, you will be 100% wrong and only have yourself to blame for not performing due diligence.

I responded to this some time ago (1-3 years ago). I also told you that she fooled you. She was one of most dishonest persons I have run into. She was on multiple dating sites (not mine). You often having some very astute observations, but this girl fooled you as she did to many other guys. She was bad real bad.

I assume this Jamie who is posting in red is the owner of the agency?

Well im not into all the issues on the board .. i have been focusing what little time i have on reading and such but Jamie sounds like a decent guy.

I mean he has a business... so he has to manage it. I respect that he comes here and posts and responds to certain posts. I believe hes the only agency ownder I have seen posy since i have been reading the boards the last week or two.

Overall he seems like a decent guy... that wins points with me.

That said i have looked around and spent my precious time at night to try to find non cheesy non sleezy dating sites. Generally been a waste of time.

But some of the ones posted in an earlier post look good... but the selections are even smaller than Jamies site for the girls i am interested in .. my taste.. style... whatever you want to call it.

Im gonna keep looking i have a few months.

I responded to this some time ago (1-3 years ago). I also told you that she fooled you. She was one of most dishonest persons I have run into. She was on multiple dating sites (not mine). no coroboration from anyone except the agency owner who already has credibility problems from his position on IMBRA and his depictions from last week. mierdre is mierdre- be warned!!!!!
