Ray have a friend in usa on J 1 visa(doctor researsh) will be usa for 5 years probably  work visa next..wants to bring her son from china  on a j2  the university hospital says no problem..  question since there is a divorce  will she need permission from the father to bring her son  either in china or in usa

The State Dept doesn’t usually get involved in custody type stuff when they issue visas and I don’t think the immigration officers at the POE will either.

Many countries have laws and protections regarding children traveling outside the country without a parent or with only one parent. I have no idea what the government policy is in China regarding children leaving the country. She should check with her consulate here for any required legal clearances or permissions.

I know in my case, my ex being from Mexico and me from Canada, that the divorce agreement must be shown showing who has custody as well as written authorization from the other parent.  I would assume it's simular for China and the US as well.
