Questions on "U Visas"

Hi All,
A close friend is going through a situation. His girl of 3 years who has questionable immigration status,  out of no where decided to call the police over a simple disagreement (He barley even raise his voice). A police report was filed. Two days later she filed a restraining order claiming mental abuse.
He feels she only wants to build a child support case while I feel she is setting him up so she may apply for a U Visa.
Is anyone here familiar with the U Visa or have any first hand experience?

I had the same exact thing happen with me and my trainwreck calena ex wife, The same MO as your friend's loco stupida. They all try to play that game  and i know for a fact my ex was coached by the Latino community on how to do this. From conversation with Immigration officials and also Attorneys, it should not really pose much of a problem for you friend. The ways the enforcement of the laws are today, the minute she stepped foot in The USA, she was here to stay, regardless of if she trays to build a bogus case or not. B50, that is what they are called in NC where i live, can be served on anyone for any reason without any evidence anything even happened. I expect the scammer Latina will not even show up for the court date as Latinas hate confrontation and also i expect she will not spend the $$ to hire an attorney. Mine never showed and the judge looked at the case and laughed and threw it out of court.

It wont be a U visa- those arent very easy to get. We have trouble getting any action on U visas for smuggled aliens assisting the government. Appearance on a minor civil restraining order does not rise to the level of inviting her to stay due to her invaluable testimony.

Child support? They have a child together? Not married? However, DV can be controlling on custody issues in some jurisdictions.

From what I read it appears they are not actually giving out U Visas at this time, but will grant a U Visa temp status for up to one year and then if and when they do start to grant the actual Visa, the Petitioner will be on the list.

They were never married, though they do have 2 children together and yes she is here illegal.
