Fiancee' Visa from Thailand
« on: November 20, 2006, 09:08:41 PM »
Hello all,

Has anyone recently gotten a fiancee visa from Thailand? Have read about visa from the Phils and from China and seems there is quite a backlog in the Phils. I have not read anything about the time it takes in Thailand. Anybody know?

Thanks, Dummy

The post at bangkok is pretty slow and pretty un cooperative. Very slow on getting out their packets. Last one I had took 14 weeks at the post to clear.

Thank you William. Does that include the time from when they get paperwork I file in US, thru the interview process and Visa to Fiancee'? I am going to file paperwork this week in the States and she is gathering list of things she needs so she is ready. Any idea how long it takes to process paperwork stateside and get it to Embassy in Thailand? I am looking for an average total time. Is it 5-6 months best case?

Thanks, Dummy

what service center are you under?
CSC is now under 60 days on the US end for the cases I am seeing. NSC lags behind.

range is 4-8 months all countries excluding Guangzhou and Manila. I will be in Thailand next week as I want to experience the waiver process first hand ;D

Hi William,

Help! I’m confused by the processing times for fiancée petitions that you reported.

The CIS Processing Date Reports posted November 17, 2006 show CSC working on I-129F petitions received on April 18, 2006 which indicates approximately a 7-month delay in processing.

Also, it was my understanding that both the Nebraska and Texas Service Centers have been forwarding their I-129F (and I-130) petitions to California (CSC) for processing for some time now. The processing time reports for NSC and TSC usually indicate “See CSC” or something similar for I-129F or I-130 processing dates. I notice that on the latest reports posted on 11/17/06, that TSC and NSC no longer even include I-129F and I-130 petitions in their reports.

https://egov.immigration.gov/cris/jsps/ptimes.jsp

Are the published processing dates that far off from reality? I understand that most all fiancée petitions were seriously delayed earlier this year because of the new IMBRA requirements.

Thanks,

Ray

UPDATE: I checked over at VisaJourney.com and it seems that recent I-129-F's are being approved at CSC in about 3 months, so I guess the CSC processing reports are definitely way off from reality.

I usually go with my cases to figure out real time processing rather than JIT reports. I remeber a time not so long ago when Texas used to leave the cases on the dock for a month before logging them in so they could show 90 day completions. Accounting tricks I guess.

My real time reports have ranged from a couple of months faster to a couple of weeks slower

Darn right IMBRA screwed up the process back in March-May.

I also try to discount those few cases that get done in a week or so when we are lucky enough to get pulled for training purposes.

Once the drain is out of the tub, the water does flow out.

Anyway, processing times are dropping again

Not due to anything I do different. I dont even claim to use magic blue envelopes that one attorney used to claim got him faster processing.

The forms are easy to fill out so I do not see a need to have a lawyer do that. Is there any truth to the claims that they can speed up the process? If they can save a month or two I would be willing to shell out the clams. A week or two, dont think so.

Ok, I am now confused by Rays post. There is a service center in Missouri, but website says they are working on I-129F files from May 16, 2006. When I looked for other Centers, Missouri was not even listed to have a site and my state was listed under the Nebraska service center. The NSC did not show a date that they were working on for the I-129F forms so I assumed they were just caught up. Yeah I know, that is laughable. I was even in the military where it is always "hurry up and wait" so I have no idea why I would think our Gov was right on top of anything. So anyway, sounds like if I send it to Missouri center it will sit on somones desk for a few weeks, be forwarded to Nebraska, sit on someones desk for a few weeks, and then be forwarded to California? Nice, real nice. Do you have to go thru proper chanels or will they let you just send it straight to the CSC?

Thanks, Dummy

Hi Dummy,

The service center in Missouri is called the National Benefits Center (NBC) and they process mostly K-3/K-4 spousal petitions, which also use the same Form I-129F. NBC does not do fiancée petitions so do not send it there!

I believe that the Nebraska Service Center is now forwarding all of their I-129F fiancée petitions to California for processing, same for Texas. You should still send your petition to Nebraska as per the instructions.

Apparently, when IMBRA screwed up processing times earlier this year, processing did eventually catch up for the most part but the CIS processing reports still show I-129F’s stuck on April/May. For actual current processing times, check the forums at VisaJourney.com.

I don’t think an attorney can get your petition processed any faster for most normal cases. My feeling is that an attorney can get busy and may not pay as close attention to tracking your case as you can. And you still have to gather the documents and evidence anyway for the attorney to prepare the paperwork. However, if you are a special case or there are problems with your petition, an attorney can be a big help in getting past any hang-ups in the system. Also, an experienced attorney should be able to prepare a good error-free submittal package, which could eliminate delays caused by improper documentation, etc.

If you do hire an attorney to help you file, I would highly recommend that you find an experienced immigration attorney who is a member of AILA. He doesn’t necessarily have to be located in your area.

MSC is for K3 only.

You have to file it in the service center with jurisdiction over your state.

People hire attorneys for the peace of mind. THis isnt particularly difficult but for attorneys with experience in this area it almost like reflexes. You can also buy a book to help you. I would suggest mine naturally ;D. Concise, up to date, etc.

I agree with the AILA recommendation, I have been a member for years
