IMBRA TRO Denied!

I had not seen it on this forum, or others, but today I found the judge's decision, on www.imbra.org, denying European Connections the temporary restraining order that they requested back in March.  

The judge felt that the plaintiff failed to show that our (American men's) Constitutional rights are violated to such an extent that the plaintiff would likely win a suit against the Government.  The gist of the opinion is that while IMBRA does impede the ability of an American man to meet and marry a foreign woman, it does not impede the ability to marry, period.  The Constitution protects the right to marry, period.  It does NOT protect the right to marry particular classes of women, such as by nationality.  

This is another brick in the wall!

This is a seperate case in Ohio, not the EC TRO (which was approved in Georgia)

I went back to read it more carefully.  YOU ARE CORRECT!!!!  I didn't know about the Ohio case.  I had only heard about the Georgia case.

I thought the Georgia case was going to be heard in April and the judge give his decision on May 24.  Since that is not what happened, then what's going on with the Georgia case?  Is it still pending?  Did the judge reject the government's case and issue a permanent TRO?

Gary Bala, do you still read this forum?  Can any immigration lawyer shed some light?

The judge is still waiting on the Gov't to get it's $hit together and come back to the table. The TRO remains in effect until they decide they are ready to return to court and present evidence that refutes E.C.'s claims.

The hearing for the permanent injunction was scheduled for today (March 20) but the Federal Attorney did not show up. The Judge extended the Temporary Injunction indefinitely until the Federal Attorney requests a new date for the Permanent Injunction hearing.

The judge is still waiting on the Gov't to get it's $hit together and come back to the table. The TRO remains in effect until they decide they are ready to return to court and present evidence that refutes E.C.'s claims.

Funny that - If *I* didn't show up for a court hearing (Federal no less!) the judge would kick it to the curb in 2 shakes - What a faqed up process....
