Quick Questions on this visa/imbra
« on: September 23, 2010, 07:25:46 PM »
OK so I'm trying to learn and absorb as much of this stuff....But as with any gov. deal its a process. So.........
What would major factors in being rejected a fiance visa which is K-1 and the spouse visa which is K-3?

I guess all in all what are the most common factors it would be denied...
And background information as far as criminal and other things, Per say She did something and never told me about it
or vice versa.

If someone could break it down barney style for me that would be great =)

thanks

-Brett

If you haven't already, checkout Visajourney.com.Alot of good info there.Probably one of the biggest reasons for visa denial is not enough proof of relationship. You need to convince a total stranger that you have a bona fide relationship.Use photos, travel records, etc....

Yes, not enough evidence of a valid relationship is usually the biggest reason for denial. You usually must convince the interviewing officer that you are not committing visa fraud by faking a relationship. The relationship evidence may be a lot tougher for a K-1 than for a K-3 or CR-1.

A lack of minimum steady income for the petitioner is another reason for denial. They prefer to see a steady income from full-time permanent employment.

Though not as common, problems with her medical exam can result in denial.

Another reason would be a prior marriage without proof of legal termination.

It is imperative to keep good records of correspondence, communication, physical visits, photographs, etc., for later presentation at the visa interview. Which country she is from is a big factor in determining how tough they are on the evidence requirements.

Keep in mind that many if not most denials are not final, but may be reversed with submission of further evidence, correction of medical problems, etc.

In addition, prior K visas are looked at in connection with a waiver. Certain criminal convictions make a multiple filer ineligible for processing a subsequent K visa.

She will be required to obtain a police clearance from her country, and possibly from other countries that she has lived in, prior to her visa interview.

Any felonies, drug convictions, or prostitution for example, will usually result in a visa denial.
