Can someone here help me. I'm needing to know where I can download and which forms to download so my Fiance can fill them out while I'm over in Vietnam. I know I need a K-1 Visa form and something called a DS-156?? or something. Is there anything else I need to know. Are there any trick questions I should be aware of? Thanks guys, this truly is a happy time in my life....

BRing back with you the following to be prepared to file. . . .

passport photos of your fiancee per the specs.
Signed G325A form from her
evidence of diorces-if any
birth certificates of any aliens emigrating
English translations of the above
evidence of your meeting- pictures , hotel receipts, train tickets, boarding passes, etc.
copy of the intl passport faceplate, if available.

THis is what you start with.

Hi Mike, welcome aboard!

William gave you a pretty good list. A few more comments:

As stated, the only form you will need to bring for her to fill out is the FormG-325A (Biographic Information). All those other forms are for later. Download and print out several sets of G-325A from http://www.uscis.gov/files/form/g-325a.pdf

She will need to complete a 4-page set and sign and date each page. She can complete one page, Xerox it, and then sign each one in ink. Tip: Also have her sign 4 blank pages of the G-325A just in case you may need them later.

I would send her a copy now and have her start gathering all the information she will need to complete a draft copy of the form. Then go over it with her while you are there and help her fill it in. That G-325A link is also a PDF fillable form so you have the option to type it on-line and print it out. You could use an Internet café. Note: Make sure she uses complete middle names on the form!

In addition to the G-325A, you will need her to sign and date an original statement of mutual intent to marry. You can type up a statement from you and your fiancée stating your mutual intention to marry within 90 days of her arrival in the U.S. and then have both of you sign and date it.

You will need a recent color passport photo of your fiancée. Get several. Tip: You can get your photos made at the same time.

Take a lot of photos of both of you together, preferably with date stamps.

Get a certified copy of her birth certificate with raised seal. She will need several of these eventually. Get English translations if needed. If she has any children, get a copy of their birth certificate also. If previously married, she will need certified copies of proof of legal termination.

Save your airline ticket copies, boarding pass stubs, or whatever else you have as evidence that you were there with her.

Try to save a few original letters in the envelope with postmarks, both from you and her.

No trick questions on the G-325A but you will have more forms to complete when you get back home :-)

Thank you very much for all the information, I have one more question.

I understand I must prove my financials, How do they want the proof, can I send along copys of my W2's? how far back do they want me to go? is just this years good enough or do they want more? Also My job this year ended on september 30th and I've been on unemployment (I worked on an airforce base and our housing contract ran out)  Is this going to be a problem? I will still have the W2 for this year showing I worked all year (and every year back), I'm selling my house now and moving down to my land in Texas where I will build another one. Just the fact that I'm on unemployment right worries me a little but I think all I might have to do is send the W2's and no one will be the wiser... thanks let me know, Mike.

THe financials will be needed at the Embassy phase. You will be looking at this coming tax filing. THe embassy can request some prior years as well.

You will be using an I134 plus a current employment letter, plus bank account verification letter plus W2 plus tax return.

Again, this will be at the embassy phase several months from now, not in the Service center phase.

Mike,

You will need to submit the financial evidence that William listed.

They look at your overall financial status, but the number one criteria will be current income from permanent employment. Being unemployed would normally disqualify you unless you had other steady income or substantial liquid assets. They will want proof of current employment in the form of an employer letter and recent payroll statements, within the last month or two prior to the visa interview.

Like William mentioned, you still have time before her visa interview to find new employment, which should be your priority for now. Even if you just started a new job, they will count your current income if your recent tax returns show a steady income. The ‘minimum’ required annual income will be 100% of the currently published poverty level guidelines. Do you have any other dependents?

You will need photocopies of your latest complete tax return (2006), including W-2. You should have the latest 3 years (2004-2006) tax returns available in case they ask for them and you’ll need that stuff later anyway.

Thanks for the information, I thought they just looked at W2's not curent employment status... (thanks rick for leaving out that part of it ha ha) My friend you just went through this and knew of my unemployment status right now (but is on a fishing boat so I cant talk with him)... Ok I leave on the 10th and return on the 23rd I'll be job hunting when I return so I can get the pay stubs before we even send off for ths visa, sure am glad I found you guys. I could of ended up in a mess... Thanks!

Oh and no I do not have any kids and I've never been married. I'm 29...

In case she is single and never married, one additional helpful document, not mentioned above, which is sometimes available in Asian and other countries is a certification, statement or affidavit of her singlehood, with English translation.
